Terms and Conditions
1. Prize Draw
(a) These terms and conditions apply to the Chemist Warehouse and Lip-Sachets “Be in to win a Tesla Model 3” prize draw (Competition).
(b) By entering the Competition, you confirm that you have read and agree to these terms and conditions.

2. The Promoter
(a) The promoter of the Competition is Pharmacy Investments Group Limited, at 125 Apirana Avenue, Glen Innes, Auckland 1072, New Zealand (Promoter).
(b) The address for any correspondence (including any inquiries) relating to the Competition is the business address of the Promoter in clause (a) above.

3. Competition Period
(a) In New Zealand, Competition entries can be made from 9.00am NZDT on Monday 9 May 2022 until 11.59pm NZDT on Sunday 4 September 2022 (Competition Period).

4. Entry Requirements
(a) Competition entries must be made through the Promoter’s website, at www.chemistwarehouse.co.nz/tesla during the Competition Period.
(b) To be eligible to enter the Competition an entrant must have purchased a Lipo-Sachets® 30 pack in-store or online at Chemist Warehouse in New Zealand during the Competition Period and have proof of the purchase in the form of a valid purchase receipt number or valid online order number. Each such purchase entitles an entrant to one entry into the Competition.
(c) To enter the Competition, you must complete the required details, including the purchase receipt number or valid online order number on the online entry form available at www.chemistwarehouse.co.nz/tesla.
(d) Multiple entries may be made by eligible entrants, subject to entrants holding multiple proofs of purchase with different valid purchase receipt numbers (or valid online order numbers) for the relevant Lipo-Sachets® 30 pack in-store or online at Chemist Warehouse in New Zealand.
(e) Entries received outside the Competition Period will not be eligible for the Competition and will not be accepted by the Promoter.
(f) Entries that are incomplete, illegible or indecipherable (as determined by the Promoter) will not be eligible for the Competition and will not be accepted by the Promoter.
(a) The Promoter takes no responsibility for entries that are late, lost, stolen, illegible, misdirected or damaged, however caused (including but not limited to entries not received due to technical problems).
(g) Without creating an obligation to do so, the Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process, for submitting an entry which is not in accordance with these terms and conditions or for engaging in improper or unlawful conduct that may affect the fair and proper conduct of the Competition.
(h) The Promoter is under no obligation to engage in any form of correspondence whatsoever with entrants or purported entrants, or their representatives, in any matters relating to the Competition.

5. Who May Enter
(a) The Competition is only open to persons who:
a. are New Zealand citizens or permanent residents of New Zealand (being persons holding a current New Zealand Permanent Resident Visa);
b. are aged 18 years or over; and
c. hold a valid New Zealand drivers licence or such other drivers licence accepted by the New Zealand Government to legally drive a motor vehicle in New Zealand.
(b) The following persons are not eligible to enter the Competition:
a. employees or independent contractors of the Promoter or AFT Pharmaceuticals Limited;
b. persons to whom (or persons who are employed or engaged by an entity to whom) the Promoter has contracted work in relation to the Competition;
c. persons who are (or have been) otherwise directly involved with the Competition; and
d. immediate family members of any of the above-mentioned persons.

6. Prize
(a) The prize is one new white Tesla Model 3 2022 with automatic transmission and rear wheel drive, including registration and dealer delivery charges (Prize).
(b) The total prize value is $74,443 NZD including ORC (on road costs) and GST . The Promoter accepts no responsibility for a change in the ultimate prize value between now and the prize redemption date.
(c) Any costs or expenses incurred by the Winner in connection with the Competition and the Prize (including collection of the Prize) are the sole responsibility of the Winner (including any vehicle insurance costs, travel and accommodation costs, power supply and all other ancillary costs associated with the collection and use of the Prize). Any tax liability arising as a result of accepting the Prize is the sole responsibility of the Winner.
(d) The Prize is not transferable except in accordance with clause (f) below, and will not be exchanged or redeemed for cash.
(e) If any Prize item is unavailable, despite the Promoter’s reasonable endeavours to procure it, the Promoter reserves the right to substitute a different prize of equal or greater value.
(f) If the Winner is, through any legal incapacity or otherwise, unable to register the Prize in his or her own name, the Winner may assign the Prize to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the Winner and the assignee.
(g) The Promoter makes no representation nor provides any warranties as to the quality or suitability of the Prize.
(h) The Winner acknowledges and agrees that in no circumstances will they be eligible to claim the clean car rebate in connection with the Prize.

7. Selecting the Winner
(a) One entrant will be selected as the Competition Prize winner (Winner).
(b) The Winner will be randomly selected using automated competition drawing software on Monday 12 September 2022.
(c) The Winner will be notified by SMS or email by 5.00pm NZDT on Monday 12 September 2022.
(d) If an entrant does not confirm (by email, by SMS or by phone) receipt of this notification and acceptance of the Prize by 9:00am NZDT on Monday 19 September 2022, the entrant forfeits the Prize and the Promoter may re-draw a new Winner (and will notify the new Winner by SMS or email) by 5.00pm NZDT on Monday 19 September 2022. Any redraw will be undertaken using the method specified in clause (c) above.
(e) A person purporting to be a Winner will be required to provide proof of identity and to verify any other eligibility requirements at the time of confirming acceptance of the Prize. If satisfactory proof and verification is not provided at this time (as determined by the Promoter), the entrant forfeits the Prize and the Promoter may re-draw a new Winner.
(f) The Promoter reserves the right to disqualify the Winner (and select another Winner).
(g) The Promoter’s decision is final and no correspondence will be entered into, including in the event of a dispute.

8. Collection of the Prize
(a) The Winner must collect the Prize from Chemist Warehouse Glen Innes located at 131-133 Apirana Avenue, Glen Innes, Auckland, 1072 on the date and at the time notified by the Promoter. The Winner should allow up to 12 weeks from the date of the draw for the Prize to be available for collection.
(b) The Winner must provide the Promoter with a certified copy of his or her valid driver’s license before the Prize can be collected.

9. Promoting the Winner
(a) On 12 September 2022 (or, if applicable, the date of any re-draw), the Promoter will publish the Winner’s name on the following websites:
a. www.chemistwarehouse.co.nz/tesla
b. www.lipo-Sachets.co.nz
This information will remain posted on the above websites for at least 30 days.
(b) By accepting the Prize, the Winner consents to his or her name and/or photograph being used for publicity purposes as reasonably determined by the Promoter. The Winner agrees to make themselves reasonably available for this purpose, without compensation. In the event they are the Winner, each entrant consents to the Promoter and its licensees and representatives using the entrant’s name, likeness, image and/or photograph and voice, in any media for an unlimited period of time, without remuneration or compensation, for the purposes of promoting the outcome of the Competition.
(c) As a condition of accepting the Prize, the Winner may be required to sign further documentation as and, in the form, reasonably required by the Promoter in its absolute discretion, including but not limited to a legal release and indemnity form and documentation required to conduct a Criminal Record Check.

10. Privacy
(a) In accordance with the Privacy Act 2020, the Promoter notifies entrants that entry in this Competition involves the collection of personal information about entrants (which may include their name, address, mobile phone number, email address and photograph). This is collected for the purposes of establishing eligibility, carrying out the Competition, promoting the Competition and the Winner and, as necessary, identity verification and assessing compliance with these terms and conditions and the law. If the requested information is not provided, the entrant will not be eligible to participate in the Competition.
(b) The Promoter may disclose an entrant’s personal information to its licensees, representatives, other parties involved in administering the Competition, and any regulatory authorities (as required).
(c) By entering the Competition, each entrant consents to:
a. the promoter’s privacy policy, which is available on the Promoter’s website at www.chemistwarehouse.co.nz/aboutus/privacy;
b. receiving ongoing communication from the Promoter (or its related entities), including its newsletter and other promotional material; and
c. receiving commercial electronic messages (including SMS and email messages) from the Promoter (or its licensees) throughout the duration of the Competition and subsequently until such time as the entrant notifies the Promoter that he or she no longer wishes to receive such messages.
(d) It is the entrant’s responsibility to notify the Promoter if his or her contact details change during the period of the Competition. A request to access or modify any information should be directed to the Promoter at the address specified in clause 2 above.

11. Discontinuation of the Competition or Disqualification of an Entrant
(a) The Promoter reserves the right to discontinue the Competition at any time and in its sole and absolute discretion may cancel, suspend, terminate or modify the Competition without the need to provide compensation to entrants or attempted entrants.
(b) The Promoter reserves the right, in its sole and absolute discretion, to verify the validity of entries and entrants and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with (or whom the Promoter reasonably suspects has tampered with) the entry process or the winner selection process or who has (or the Promoter reasonably suspects has) otherwise been misleading or fraudulent in the course of the Competition.

12. Exclusion of Liability
(a) The Promoter and AFT Pharmaceuticals Limited are not responsible for the transmission or receipt of any incorrect information associated with entries, caused either by user error or any equipment or programming malfunction associated with the Competition.
(b) To the extent permitted by law, the Promoter is not liable (to any person, including any entrant or any or their representatives) for any loss or damage suffered or sustained by any person or to personal property, including, but not limited to, indirect, consequential or economic loss by reason of any act or omission, deliberate or negligent, by the Promoter or its personnel, representatives or agents, in connection with the Competition or the Prize.

13. Other Terms
(a) If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions or otherwise running the Competition as planned (including anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition), the Promoter will not be liable for any failure to perform or delay in performing its obligations.
(b) Failure by the Promoter to enforce any of their rights under these terms and conditions at any stage does not constitute a waiver of those rights.
(c) These terms and conditions are governed by the laws of New Zealand.
